1. Agreement

These Terms of Use apply to the PanProfit website and app at panprofit.com ("PanProfit", "we", "us"). By using PanProfit you agree to these terms. If you do not agree, please do not use PanProfit. Our Privacy Policy explains how we handle information.

2. The service

PanProfit helps small food businesses estimate recipe costs, margins and selling prices. It is currently free during early access. We may add, change or remove features, introduce paid plans, or limit some features to paid plans in the future.

3. Your responsibility for results and decisions

PanProfit calculates results from the information you enter, such as ingredient prices, quantities, yields, waste and other costs. If that information is incomplete or wrong, the results will be too. Suggested prices and benchmarks are general guidance, not recommendations for your specific business.

• PanProfit does not provide financial, accounting, tax, legal or business advice.
• You are solely responsible for checking the results and for your prices and business decisions.
• You are responsible for complying with the laws that apply to your business, such as cottage food rules, permits, food safety, labeling and taxes.

4. Your data and backups

The recipes and other data you enter are stored in your browser on your device, not on our servers. They can be lost if you clear your browser data, use a private window, change devices or browsers, or if your device fails. You are responsible for keeping backups, using the Backup & Restore feature in the app. We are not responsible for any loss of data stored on your device.

5. Acceptable use

You agree not to:

• use PanProfit for anything unlawful;
• interfere with or disrupt PanProfit, or try to gain unauthorized access to it;
• send spam, abusive content or automated submissions through the app's forms;
• copy, resell, redistribute or publish PanProfit, or offer it as your own product or service.

6. Ownership

PanProfit, including its software, design, text and graphics, belongs to us and is protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable permission to use PanProfit for your own business or personal purposes under these terms. The recipes and data you enter remain yours.

7. Feedback

If you send us ideas or suggestions, we may use them to improve PanProfit without any obligation to you.

8. No warranties

PanProfit is provided "as is" and "as available", without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that PanProfit will be uninterrupted, error-free or secure, or that its calculations will be free of errors.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising from or related to your use of, or inability to use, PanProfit, even if we have been advised of the possibility of such damages. Our total liability for any claim related to PanProfit is limited to the amount you paid us for PanProfit in the twelve months before the claim. While PanProfit is free, that amount is zero.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.

10. Changes, suspension and termination

We may change, suspend or discontinue PanProfit, or any part of it, at any time. We may limit or end anyone's access to PanProfit at our discretion, for example in case of misuse of these terms. We may update these terms from time to time; the date at the top shows the latest version. By continuing to use PanProfit after an update, you accept the updated terms.
